GENERAL TERMS AND CONDITIONS OF SALE

The company IPN (hereinafter referred to as THE SELLER) is registered with the Trade and Companies Register under number RCS 479 971 863. Its postal address is 1bis, avenue du Cep – 78300 POISSY, France, and its email address is bonjour@lacompagniedukraft.com (hereinafter THE SELLER’S ADDRESS).

Any order placed for a product listed in the online store on the website www.lacompagniedukraft.com (hereinafter THE SELLER’S WEBSITE) implies prior consultation and full acceptance of these general terms and conditions of sale. Confirming an order by clicking the validation button constitutes full acceptance of these terms. This confirmation click serves as a “digital signature”.

These general terms and conditions aim to define the rights and obligations of the parties within the scope of online sales of goods offered by THE SELLER to the consumer.

ORDER CONFIRMATION

Contractual information will be confirmed by email to the address provided by the customer on the order form.

Proof of transaction: digital records kept in the SELLER’s computer systems under reasonably secure conditions shall be considered as proof of communications, orders, and payments exchanged between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as evidence if required.

PRODUCT INFORMATION

Every effort has been made to ensure the accuracy of the information presented on THE SELLER’S WEBSITE. However, neither THE SELLER nor its suppliers may be held liable for consequences, incidents, or special damages resulting from electronic transmissions or the accuracy of information provided, even if THE SELLER was aware of the possibility of such damages.

Product names and trademarks are used solely for identification purposes. Photos, descriptions, and prices are non-contractual.

Validity of offers and pricing: our prices are valid for the day they are displayed.

DELIVERY TERMS

Products are delivered to the address specified by the customer on the order form, and only within the geographical areas we serve. All products are shipped from our premises in perfect condition. The customer must notify the carrier (or postal worker) of any visible damage (holes, crushing, etc.) on the package and, if applicable, refuse the delivery. A new identical product will be resent at no additional cost.

Any product reported damaged after delivery, without any written note of concern at the time of receipt, will not be eligible for exchange.

As with all shipments, delivery delays or lost packages may occur. In such cases, we will contact the carrier to initiate an investigation. All necessary efforts will be made to locate the package. If unsuccessful, the seller will be reimbursed by the carrier and will send a new identical package at no extra cost.

We disclaim any responsibility for extended delivery times due to carrier issues, including loss, weather events, or strikes.

Delivery issues caused by the carrier: any delivery anomaly (damage, missing items, broken products...) must be reported on the delivery slip with handwritten notes and signed by the customer. The customer must also confirm the issue by sending a registered letter with acknowledgment of receipt to the carrier within 2 business days following delivery, clearly detailing the complaint. A copy of this letter must be sent to THE SELLER’S ADDRESS.

Without this formal process, no exchange can be processed.

Delivery errors: the customer must report any delivery error or product non-conformity (in nature or quality) on the day of delivery or at the latest on the first business day following delivery. After this period, any claim will be rejected. Complaints should be sent to THE SELLER’S ADDRESS.

IMPORTANT NOTE: In-store pickup at the Corner located within BOISNARD in Paris (75002) is offered at a reduced price of two (2) euros including tax. However, deliveries occur only once a week, on Thursdays. Thus, an order placed before Monday at 5:00 PM can be made available by Thursday midday. Any order placed after 5:00 PM on Monday will be available the following Thursday — i.e., up to 8 days later.

Any claim not made in accordance with the procedures and deadlines outlined above will not be taken into account and will release THE SELLER from all liability to the customer.

In the event of a delivery error or exchange, any product to be returned must be sent back in full and in its original, new-condition packaging to THE SELLER’S ADDRESS. Returns must be pre-approved by THE SELLER, who will then provide return instructions. Shipping costs will be covered by THE SELLER, unless the returned product does not match the original customer statement made on the return request.

Product warranty: these terms and conditions do not limit the customer’s legal rights, in particular the legal guarantee protecting consumers against hidden defects in the sold goods.

RIGHT OF WITHDRAWAL

The right of withdrawal applies only to individual consumers.

In accordance with Article L.221-18 of the French Consumer Code, you have 14 calendar days from the date of receiving your order to exercise your right of withdrawal — without having to provide any reason or pay penalties.

FORCE MAJEURE

Neither party shall be held liable for failing to fulfill contractual obligations if performance is delayed, hindered, or prevented due to a force majeure event.

A force majeure is defined as any event or circumstance that is unforeseeable, irresistible, external to the parties, unavoidable, and beyond their control — and which cannot be prevented despite reasonable efforts.

The affected party must notify the other party within ten (10) business days of becoming aware of such circumstances. Both parties will then consult, within three months (unless prevented by the force majeure), to assess the impact of the event and agree on conditions for continuing the contract.

If the force majeure lasts more than one month, these terms and conditions may be terminated by the affected party.

Explicitly, in addition to cases typically recognized by French courts, force majeure includes: transport strikes or blockages, earthquakes, fires, storms, floods, lightning, telecom network outages, or disruptions to external telecommunications beyond the client’s control.

Partial invalidity: if any provision of these terms is held to be invalid or declared as such under applicable law, regulation, or final court decision, the remaining provisions will remain fully effective.

No waiver: if one party does not enforce a right or obligation outlined in these terms, it shall not be interpreted as a waiver of that right for the future.

Governing law: these terms and conditions are governed by French law — for both substantive and procedural rules.

In the event of any dispute or claim, the consumer must first contact THE SELLER in an attempt to reach an amicable solution.

PERSONAL DATA PROTECTION

All data you entrust to us is necessary for processing your orders.

In accordance with French law no. 78-17 of January 6, 1978 on data protection and privacy, you have the right to access, modify, rectify, or delete any personal data shared with THE SELLER. This right may also be exercised online.

Disputes: any order placed through THE SELLER’S WEBSITE implies full and unreserved acceptance of the seller’s general terms and conditions of sale. In the case of a sale to a legal entity, any dispute regarding the sale (pricing, T&Cs, products…) shall be subject to French law and referred to the Commercial Court of the SELLER’s registered office.
